Communist Review - Together with the function of being constitutional, legislative and making decisions on the important issues of the country, the supreme supervision of the National Assembly has an extremely important position and role in the mechanism of organization, operation, enforcement and control of power of the State. Inheriting and promoting the 76-year long glorious traditions, thoroughly grasping the Program, viewpoints and lines of the Party, before the requirements and tasks of national development in the renovation time, the National Assembly continues the tremendous renovation of mindset, the way of doing things to further improve the quality, effectiveness of the supreme supervisory activities.

Being the highest State authority, the highest representative agency of the people, the National Assembly of Vietnam has always manifested its position and role of special importance in the entirety of mechanism of organization, operation, enforcement and control of the state power, always affirmed the abilities of a National Assembly that operates in the interests of the people, of the country. In the light of Ho Chi Minh thought and the viewpoints and lines of the Party, the National Assembly in each of its term has acted resolutely so as to institutionalize fully and in time the will and aspiration of the people, the resolutions of the Party into the stipulations of the law with close supervision, thus making the law take effects in reality, promote the role and effectiveness of the democratic, representative mechanism in practicing democracy, ensuring and protecting the legitimate, legal rights and interests of the people, firmly maintaining the social discipline, making a contribution to controlling the State power.

Besides its function of being constitutional, legislative and making dicisions on the important issues of the country, the National Assembly is the only one State agency entrusted by the people to carry out the right of supreme supervision over the State activities in order to make a contribution to controlling the power, ensuring the organization of effective implementation of the lines and advocacies of the Party, the policies and laws of the State. At present, the control of State power in Vietnam has been implemented in many different modes: the control by the state power principle of unification with the distribution, coordination and control among the state agencies in implementing the legislative, executive and justice rights; the control inside each state agency; the control by the inspection, supervision of the Party over the party organization and party members that operate in the state apparatus; the control by the mechanism of inspecting, examining, auditing over the operation of the state agencies which implement the justice rights and join the implementation of the justice rights; the self-control by fulfilling the responsibilities of setting examples, “self-examination”, “self-correction”, self-criticism and criticism, in combination with the building of power-holding morality, the higher position, the better example should be set; inspection by the good governance based on the principles of openness, transparency, accountabilities, protection of human rights, the citizenships, inspection through supervision and social debates of the Fatherland Front, of the social and political organizations and of the people; inspection through monitoring public opinions and debates of the press, in which the supreme inspection of the National Assembly is the mode of important power control and of fundamental character in the mechanism of power control in Vietnam now.

1. To implement the goals and tasks of the national development in the new period, together with the requirements of building and perfecting the socialist rule-of-law State and the socialist democracy, that the position and role of the National Assembly in the organization of the State power are affirmed, the mechanism of representative democracy is fully promoted, the efficiency and effectiveness of the operation of the National Assembly is improved has always been the concerns of the Party and the State of Vietnam, especially the activities of supreme inspection. This has been reflected in the Party’s lines and advocacies.

The 10th Congress of the Communist Party of Vietnam (April 2006) affirmed the advocacy of “Building the operational mechanism of the socialist rule-of-law State, ensuring the principle that all the state powers belong to the people” (1), in which it is necessary “to build and perfect the mechanism of inspection and supervision of constitutional and legal character in the activities and decisions of the public authorities” (2); at the same time, it is determined “to continue the renovation of organization and operation of the National Assembly…. To implement better the tasks that decide all the important issues of the country and the function of supreme supervision” (3). The Conclusion No. 144-TB/TW on March 28, 2008 of the Political Bureau, “On a number of issues on organization and operation of the National Assembly and the Party and the Youth Union of the National Assembly” has affirmed that the correct awareness of the importance of supervisory activities, the active perfection of the legal basis, the renewal of the mode of supervision and the enhancement of the close leadership of the Standing Committee of the National Assembly are the very important factors that make a contribution to improving the quality and effectiveness of the supervisory activities of the National Assembly.

The 11th Congress of the Communist Party of Vietnam (January 2011) has deepened further the awareness of building the socialist rule-of-law State. The Program on national construction in the transitional period to progress to socialism (added, developed in 2011) of the Party determined that one of 8 characfteristics of the socialist society that the Party and the people of Vietnam have striven to build is: there is the socialist rule-of-law State of the people, by the people, for the people under the leadership of the Communist Party of Vietnam. Especially, for the first time in the documents of the Party’s Congress, the principle of power control has been recognized. Accordingly, “To study to build and add the specific institutions and mechanisms of operation so as to ensure the principle that all the State powers belong to the people and the principle of State power is the unification with the distribution, coordination and inspection among the agencies in implementing the legislative, executive and justice rights” (4). The 11th Party Congress affirmed to continue the renovation of organization and operation of the National Assembly, to ensure that the National Assembly is really the superme representative agency of the people, the supreme state power agency that “Implements better the decisive tasks and supervises the important issues of the country, particularly the key works of the country, the distribution and implementation of the budget; the supervision of the activities of the justice agencies, the prevention of bureaucracy, corruption and wastefulness” (5).

The 12th Congress of the Communist Party of Vietnam (April 2016) is consistent in the viewpoints of enhancing the building and perfecting of the socialist rule-of-law State of the people, by the people, for the people in the new development stage. It points out the orientation of “Continuing to renovate the organization and operation of the National Assembly, to ensure that the National Assembly is really the supreme representative agency of the people, the supreme State authority. The National Assembly has carried out the legislative function, making decisions on all the important issues of the country and supreme supervision, particularly the legislative activities of the National Assembly, the National Assembly deputies, the inspection and assessment mechanism for those who hold the key posts elected or ratified by the National Assembly, the People’s Councils. To further enhance the attachment between supervision of the National Assembly with the inspection and supervision of the Party, the Fatherland Front, the political and social organizations and monitoring of the people”(6).

Inheriting and developing the viewpoints already determined in the Documents of the Party Congresses of the previous tenures on building and perfecting the socialist rule-of-law State, in which there are the tasks of renewing the organization and operation of the National Assembly, the 13th Party Congress stressed that it is necessary “to Renew the mode, to improve the quality and the effectiveness in operation, to promote democracy, rule of law, increase the professionalism in the organization and operation of the National Assembly, in implementing its legislative function, in making decisions on the important issues of the country and the supreme supervision; to perfect the mechanism of prorecting the Constitution, the mechanism of supervision, to cast the confidence vote for those who hold the key posts elected or ratified by the National Assembly, in the People’s Council” (7). At the opening meeting of the first session of the 15th National Assembly, General Secretary Nguyen Phu Trong gave the guidance: “To continue the renovation, raise the efficiency and effectiveness in the thematic supervisory activities, in the interpellation”, “to pay attention to supervising the implementation of post-supervisory conclusions and petitions”.

By implementing the Resolution of the Party’s 13th Congress, thoroughly grasping the guidance of the General Secretary, the renovation and enhancement of the supervisory work have been determined clearly as the important, key link to improve the efficiency and effectiveness in operation of the National Assembly. The supreme supervisory activities in particular and the overall supervisory activities of the National Assembly in general should be kept close to the important tasks set in the Documents of the 13th Party Congress, the resolutions and instructions of the Party Central Committee, of the Political Bureau and of the Secretariat, particularly the major issues such as the concerns, the growth model, the stability of macro economy, the restructure of the economy, the implementation of the national important projects, the administrative reform, the arrangement and streamlining of the state apparatus, the public service units, the issues on culture, social security, international integration and economic cooperation, the guarantee of national defence, security, social order and safety. The supervisory activities of the National Assembly should be both kept close to respond in time the social requirements, the innermost feelings, aspirations and wishes of the people and the voters, at the same time, it is necessary to combine it with the legislative work, to provide the practical information so as to perfect the policies and laws, to raise the responsibilities of organizations and individuals in implementing the stipulations of the law, to enhance the effectiveness in operation of organizations and individuals under the supervision (8).

So, it is possible to affirm that the improvement of the effectiveness in the supreme supervisory activities of the National Assembly, the supervisory activities of the agencies of the National Assembly is the important content in the process of renovation of the organization and operation of the National Assembly of Vietnam in accordance with the viewpoints and lines of the Party on building the socialist rule-of-law State of the people, by the people, for the people.

2. One of the requirements of the building of the rule-of-law State is to have the synchronous law system, in which the supremacy of the Constitution must be ensured and must have a mechanism of effective control over the activities of the agencies within the state apparatus and first of all, to promote the role and function of supreme supervision of the National Assembly - the highest state authority.

The first 1946 Constitution of the Vietnam provided: “The Parliament is the organ with the highest power of the Democratic Republic of Vietnam”, but the supreme supervisory right was not yet clearly reflected, and it only stipulated the rights of the National Assembly in “controlling and criticizing the Government” (Article 36”. Together with it are the stipulations on the legal position, the relationship between the legislative, executive and justice agencies in the mechanism of operation of the state power in accordance with the mindset of “implementing a strong and clear-sighted administration of the people” (According to the Preamble of the 1946 Constitution) played a decisive role, contributing to controlling the power of the state apparatus.

The 1959 Constitution had a development in the supervisory right of the National Assembly of Vietnam with the provision: “The National Assembly is the highest State authority agency of the Democratic Republic of Vietnam” (Article 43) and “The National Assembly is the only agency that has the legislative right of the Democratic Republic of Vietnam” (Article 44). Even though the supervisory right was yet to be considered as an important function of the National Assembly like the later Constitutions, the 1959 Constitution had determined clearer the character and the position of the National Assembly in the organization of the state apparatus of our country at that time, defined more concretely with the larger scope and objects, like the stipulation in the supervisory activities of the National Assembly for the work of the Governmental Council, the Supreme People’s Court, the Supreme People’s Procuracy (Article 53). The supremacy of the supervisory right of the National Assembly was yet to be mentioned directly in the language of the Constitution, but the provisions of the Constitution concerning this supervisory right had implied the supreme significance and the supervisory scope began to include the activities of the State.

And here came the 1980 Constitution and particularly the 1992 Constitution, “that the National Assembly practiced the supreme supervisory right in the whole of the State’s activities” (9) had been officially affirmed. On that basis, the content of the supreme supervisory right of the National Assembly as well as the forms for the National Assembly to exercise this right had been concretized through the privisions of the Constitution, the Law on the Organisation of the National Assembly, the Law on the Supervisory Operation of the National Assembly and the People’s Council and some other documents. It can be said that the 1980 Constitution and the 1992 Constitution had not only manifested the important development in the supervisory right of the National Assembly, but also raised this right to a new height. According to the provisions of the 1980 Constitution and the 1992 Constitution, the supreme supervision of all the activities of the State is not only the supreme right, but also the special function of constitutional stipulation of the National Assembly of Vietnam.

Inheriting and developoing the core values from the previous Constitutions, the 2013 Constitution has expressed the right supreme supervisory function of the National Assembly in the spirit: “To implement the supreme supervisory right in accordance with the Constitution, law and resolution of the National Assembly” (Article 70). As for the provincial level and lower level, according to the Law on Organization of the National Assembly in 2014, the Standing Committee of the National Assembly is the agency which has the right to supervise the activities of the People’s Council; the Ethnic Council and the Committees of the National Assembly have the supervisory right related to the operation of localities in a number of specific affairs and areas (10). According to the Law on Supervisory Activities of the National Assembly and the People’s Council in 2015, the Standing Committee of the National Assembly supervised the election of the representatives of the People’s Council, the Delegation of Deputies of the National Assembly had exercised the thematic supervisory activities concerning the law enforcement in localities.

For the first time in the constitutional history, the 2013 Constitution determined the issues of inspecting the power in accordance with the principle: “The state power is unified, with the distribution, coordination and inspection among the state agencies in exercising the legislative, executive and justice rights” (Clause 3, Article 2); ensures the continuity of building and perfecting the socialist rule-of-law State, contributing to preventing and guarding against the abuse of power, going beyond the people’s proxy.

On the basis of the provisions of the Constitution, the legal system concerning supervision has been step by step concretized and perfected, especially the Law on Supervisory Activities of the National Assembly and the People’s Council, “the Regulation on organizing the implementation of a number of supervisory activities of the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Delegations of Deputies of the National Assembly, the National Assembly deputies” (11) are the fundamental and extremely necessary legal foundation to implement in a unified and effective manner the supreme supervisory activities of the National Assembly, the supervisory operation of the Standing Committee of the National Assembly and of the above-said agencies. Apart from that, the National Assembly has concretized the mechanism of controlling powers which is provided in the Constitution in the laws on organization of the state apparatus and other special sectors such as the Law on Organization of the National Assembly, the Law on Organization of the Government, the Law on Organization of the Supreme People’s Court, the Law on Organization of the Supreme People’s Procuracy, the Law on Organization of Local Authorities, the Law on State Audit, the Law on Election of the National Assembly Deputies and the People’s Council deputies, the Law on Anti-Corruption Combat and so on. Through that, the National Assembly has made specific provisions on the tasks, rights and organization of the apparatus of these agencies so as to contribute to forming the concrete mechanisms of power controlling to be suitable to the position and character of each power institution.

3. Thoroughly grasping the viewpoints and lines of the Party, the provisions of the Constitution, the law, especially implementing the orientation of General Secretary Nguyen Phu Trong at the first session of the 15th National Assembly “To continue the renovation, improve the efficiency, effectiveness of the supervisory operation, particularly the thematic supervision, the interpellation operation, promote democracy, increase debates, analyze deeply, make clear the achievements, the good points, as well as the problems, shortcomkings, to find out the causes, the lessons of experience and recommend the satisfactory, feasible solutions. To pay attention to the implementation of the post-supervisory conclusions and proposals”, the operation of the National Assembly in general and the supervisory operation of the National Assembly in particular have expressed clearly the spirit of renovation, creativeness, the action in the interests of the people, of the country.

In this spirit, the supreme supervisory right at the session of the National Assembly has been enhanced through the activities of considering reports, supervising the subjects, putting questions and answering questions, getting the confidence votes and so on, together with the results of the supervisory activities of the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Delegations of Deputies of the National Assembly and the National Assembly deputies with the scope of supervision concentrating on the major, important or urgent issues of life, covering almost all areas. Through the supervisory activities, the correctness of policies, laws has been affirmed, whereas the limitations and inadequacies have also been found out in time so as to be able to put forth the additional recommendations, to perfect policies and laws to be served as the basis for the decision on the important issues of the country; at the same time, the political responsibilities of organizations and individuals have been recommended to ensure the disciplines and laws and whence, the concerned agencies can be fully aware of the responsibilities and carry out better their tasks. The effectiveness of supreme supervision of the National Assembly are reflected clearly in each supervisory activity, specifically:

Firstly, the consideration of reports of agencies has been implemented in an essential, responsible and effective manner and it is of important significance in contributing to controlling the power in the operation of the State President, the Government, the Supreme People’s Court, the Supreme People’s Procuracy. The reports on the economic and social issues, on the prevention of criminals and the violations of law, the execution of sentences, the prevention of corruption, the settlement of complaints, denouncements and the summary of opinions and petitions of voters have been carefully discussed. The areas that are regarded as sensitive and often have the high risks leading to the abuse of power, to “group interests”, infringing on the fundamental rights of citizens have been considered by the National Assembly and been broadcast live on the radio and television system, expressing the openness and transparency in the operation of the state apparatus. The renovations reflected in considering the reports in the form of accountability, debate and statement of counter-argument character have created the enthusiastic atmosphere in the discussions, thus making the considerations and assessments of the contents of the reports more essential and more effective. And this has helped the policies and laws go into life, suitable to the facts and compel the state-run agencies to implement correctly, seriously and equally their assigned rights; regulate in time and overcome the shortcomings and errors in the process of implementation; at the same time, it is the basis for the National Assembly to judge the efficiency and effectiveness of the operation of the agencies and the titles elected or ratified by the National Assembly.

Secondly, the interpellation activities have constantly been renewed, perfected and become an effective supreme supervisory form in the operation of the National Assembly and it has always attracted the attention and following of the people of all strata. In the constructive and responsible spirit, in the enhancement of debates and dialogues with the guarantee of democracy, openness, the interpellatilon operation has made tremendous impact on the operation of the state apparatus and the leading cadres of the state-run agencies, thus promoting the effective implementation of the line and advocacies of the Party, the policies and laws of the Sate. Through many sessions of interpellation, the inadequacies and limitations in the state management, as well as the responsibilities of the related agencies and individuals have been analyzed and made clear.

Entering the term of the 15th National Assembly, in the spirit of “the early and afar preparation”, the Standing Committee of the National Assembly and the Leaders of the National Assembly are always proactive in giving their initial opinions on the way of organizing the interpellation, the order and procedures in selecting the groups of issues for interpellation and the promulgation of the resolution of the interpellation. The resolution on the interpellation operation which is built with a lot of requirements and solutions for implementation and has the specific time limit for completion is the considerable renewal, thus helping the supervision of carrying out the promise and requirement of the National Assembly after the interpellation can be timely, feasible and valid. The selection of issues and the renewal of the method of interpellation at the sessions of the National Assembly have made a contribution to improving the effectiveness of the interpellation operation, ensure the contents of interpellation to be geared to the important points and gradually become the parliamentary culture; through which, it can help the National Assembly deputies assess the abilities of exercising the power of the answerer with the assigned authority. The results of the interpellations show the spirit of getting close to the facts, practicality, dedication, frankness and high sense of responsibilities of the interpellator and the respondent, and this has been recognized and highly valued by a lot of the National Assembly deputies, voters and people nationwide.

Thirdly, the consideration of the thematic supervion report has been paid attention to on the basis of the result of supervision of the Supervision missions set uop by the National Assembly. At the sessions, the National Assembly has always arranged the satisfactory time for consideration and discussion concerning the reports on the results of supervision by the Supervision missions and almost all of the reports have been broadcast live on the radio and television system so that the voters and people can be able to follow and supervise. In recent time, the thematic supervisory activities continue to be perfected, contributing to making clearer a lot of issues, especially the limitations, weaknesses and violations in deploying the law enforcement concerning the areas of social life. A lot of themes have got the large scope, including the economic activities and the social life selected and supervised by the National Assembly, such as the reform of the organization of the State’s administrative apparatus; the management, the use of the State’s capital and assets at the enterprises and the equitization of the State-run enterprises; the planning, management and use of land in the urban areas; the planning work; the practice of thriftiness and the combat against wastfulness and so on.

At the supreme supervisory sessions of the National Assembly, the video shows in combination with the presentation of reports by the Supervision missions are the new way of doing things, supplying much more information and lively examples, creating positive effect; creating favourable conditions for the National Assembly deputies to consider, discuss and assess more deeply and more comprehensively the supervisory content. On that basis, the National Assembly has issued the resolution on the results of the supervison to be served as the important basis to help the Government, ministries, sectors, the justice agencies and the related agencies to have the suitable adjustments in their guidance, operation and overcoming of the limitations, inadequacies, in enhancement of efficiency and effectiveness in the state management, in making clearer the responsibilities of organizations and individuals concerning the wrongdoings so as to have measures for suitable treatment in order to constantly consolidate the principle of the state; at the same time, to help the National Assembly have conditions to judge, to test, to add and to perfect the related policies and laws, thus making a contribution to implementing better the function of being legislative and of making decisions on the important issues of the country.

Fourthly, the legal documents are considered to amend, add and promulgate in time in conformity with the Constitution, law, resolution of the National Assembly, ordinance, resolution of the Standing Committee of the National Assembly. Up to now, even though the National Assembly is yet to undertake the special process of exercising its authority of supreme supervision so as to consider a legal document that has a sign contrary to the Constitution, law, resolution of the National Assembly at the session of the National Assembly as provided in Article 14 of the Law on Supervisory Operation of the National Assembly and the People’s Council; however, through the deployment of the supervisory themes, the Supervisory Missions of the National Assembly have pointed out the limitations of the legal system relating to the supervised themes, on that basis, it has proposed the authoritative agencies to perfect the related policies and laws, contributing to ensuring the synchrony, completeness and timeliness, to improving the quality of the legal documents. On the basis of the reports made by the supervisory missions of the National Assembly, the National Assembly has promulgated the resolutions so as to overcome in time the mentioned limitations, problems and inadequacies, in which there are the tasks and main solutions in urgently reviewing the legal documents system. Besides, in order to have the supervisory activities of the legal documents implemented regularly, continuously and their unification and system can be ensured, the Standing Committee of the National Assembly has issued the Resolution No. 560/NQ-UBTVQH15 on guidance of organizing the implementation of supervision of the legal documents by the Ethnic Council, the Commitee of the National Assembly; accordingly, the Ethnic Council, the Committee of the National Assembly organize the implementation of the report on the results of supervising the legal documents annually (from January 01 to December 31) so as to report to the Standing Committee of the National Assembly at the April session before submitting it to the National Assembly at the May session.

Fifthly, a special attention has been paid to the re-supervisory operation which has been manifested in following and supervising together with the implementation of the resolution of the National Assembly, raising the responsibilities of the respondent, especially the leader, and a lot of urgent issues of the economic and social life continue to be analyzed and thoroughly considered in various perspectives. Through that, voters and people nationwide can see the efforts and responsibilities of the Government, ministries and sectors in guidance, operation and responsibilities of the deputies in supervising, following the implementatilon of the requirements of the National Assembly. In the middle and the ending time of the term, the National Assembly organizes the supervison of the members of the Government concerning the implementation of the resolutions on the thematic supervision, the resolution on the interpellatilon from the early days of the term to the time of supervision so as to assess the implementation of promise of the agencies under supervision.

Sixthly, getting confidence votes for the title-holding people elected or ratified by the National Assembly continues to be the content of supervision of special importance, reflecting the degree of confidence and the recognition and the impartial and objective assessment of the efforts and results made by the people who have the confidence votes. Through that, it helps the people who get the confidence votes see clearer their responsibilities so that they can have the direction to overcome the shortcomings and defects and strive to improve their abilities and effectiveness in operation, and to exercise satisfactorily their assigned responsibilities and authorities. This is also the mode to control powers directly for the leading cadres, including the key leading cadres and the senior cadres. The results of the confidence voting is served as the “yardstick” of the effectiveness of operation of the title-holding people elected or ratified by the National Assembly; at the same time, this is the source of motive force for the highly trusted people to continue to promote and make contributions, while those people who are yet to be highly trusted will strive further to overcome their shortcomings to improve their work effectiveness.

Apart from the obtained results, the supreme supervisory activities of the National Assembly still has some limitations that need being identified so as to overcome them in the coming time in order to meet better the expectations of the voters and people nationwide. It can be affirmed that renewing the supreme supervisory activities of the National Assembly is an issue of important significance and real urgency in the context that the Party and the State of Vietnam are upholding the control of powers with a view to building and perfecting the socialist rule-of-law State of the people, by the people, for the people.

4. To continue the renovation, improve further the quality of the supreme supervision of the National Assembly in the direction of concentrating on supervising the operation of the executive and justice agencies, other agencies set up by the National Assembly, the title holders elected or ratified by the National Assembly, contributing to controlling the power and organizing the effective implementation of the lines and advocacies of the Party, the policies and laws of the State, the National Assembly has paid attention to carrying out better a number of the following contents:

Firstly, to raise the awareness of enhancing the Party’s leadership of the operation of the National Assembly, in which it is necessary to have the correct awareness of the position and role of the Party’s leadership of the supervisory activities of the National Assembly in general and the supreme supervisory of the National Assembly in particular.

To raise the awareness of the position, role and importance of the supervisory activities of the National Assembly in the direction: The renovation and promotion of the supervision are determined as the important, key link in order to improve the efficiency and effectiveness of the operation of the National Assembly. The supervisory activities of the National Assembly need to be kept close to the important tasks set in the Documents of the the 13th National Party Congress, the resolutions and instructions of the Party Central Committee, the Political Bureau, the Secretariat and the guidance of the General Secretary; stick closely to the factual situation of the country, the practical issues, thus meeting in time the requirements of the society, reflecting the moods, aspirations and wishes of the people and voters nationwide. The supervisory activities should provide the practical information so as to perfect the policies and laws, raise the responsibilities of organizations and individuals in implementing the provisions of the law, enhance the effectiveness of the operation of the organizations and individuals under supervision.

Well aware of the position and role of the supervisory activities of the National Assembly - one of the modes of controlling the powers, the relationship between the supreme supervisory operations of the National Assembly and the supervisory activities of the agencies of the National Assembly, the delegations of the National Assembly Deputies, in which the supreme supervision of the National Assembly has occupied the central position. At the same time, the awareness of the dialectical relationship between the supervisory function and the legislative function must be raised so as to make decisions on the important issues of the country; the dialectical relationship between the supervisory activities and the building and exercising of the law, particularly the areas having a lot of problems, inadequacies; to have close linkage to ensure the effective connection and inheritance between the results of supervisory operation of the legal documents carried out by the National Assembly and the results of the examination and inspection of the quality of the legal documents implemented by the Government. To continue to push ahead the education, training, fostering, propaganda so that the supervisory subjects as well as the supervisory objects can be able to be aware correctly of the position, role and importance of the supervisory operation of the National Assembly.

Secondly, to study to determine more clearly the scope, objects, method and form of the supreme supervision of the National Assembly; to organize the effective implementation of the provisions of the law on supervisory activities, enhance the discipline in deploying the supervisory activities, focusing on a number of concrete contents as follows: to improve the quality in building the supervisory program of the National Assembly and of the Standing Committee of the National Asssembly; to promote effectively the guiding, regulating role, to coordinate the supervisory operation of the Standing Committee of the National Assembly in the direction of being proactive, unified, try to avoid having the repetition, so as to be suitable to the specific conditions and situation, to promote the effectiveness of the supervisory activities; to enhance the debates, to go deeper to make clear the issues and responsibilities in discussion, consider the reports; to continue to improve the quality of the thematic supervisory activities, in which importance is attached to using the information from the inspection, examination and audit agencies, the experts and researchers in building the reports and resolutions on supervision, to push ahead the application of information technology in the thematic supervisory activities; to continue to renew the mode and the way of organizing the interpellation and the answers in the interpellation; to enhance the interpellation activities at the sessions of the Standing Committee of the National Assembly, in which attention is paid to considering and promulgating the resolution on the interpellation to make it clear and treat in time the issues raised in the interpellation and served it as the basis to supervise the implementation; to enhance the consideration of the supervisory proposals which are yet to be implemented, considering it as the regular task of the National Assembly, of the agencies of the National Assembly; to supervise the legal documents in a regular way, to make the annual and open report to the National Assembly and to combine the supervision of legal documents with the supervision of the implementation of policies, and through that, it manifests the higher degree the responsibilities of the National Assembly to ensure that the promulgated laws have gone into life.

To enhance the supervisory activities in implementing the contents related to the foreign affairs, defence security, protection of independence and sovereignty of the country; to carry out the foreign line, expand international cooperation, attract foreign direct investment, contributing to raising the position, role and contributions of the National Assembly of Vietnam in the international and regional forums.

Thirdly, to enhance the National Assembly’s supervision in the prevention and combat against corruption, negativities and wastfulness in the direction: To deploy the supervisory operations (interpellation, thematic supervision, explanation, supervision of legal documents, supervision of the settlement of complaints, denunciations of citizens, the proposals of voters and so on), the National Assembly, the Standing Committee of the National Assembly, the agencies of the National Assembly, the Delegations of the National Assembly and the National Assembly deputies have to pay attention to the content in the prevention and combat against corruption, negativities, wastefulness, determined that this is the regular and important task that should be carried out in an open and all-round way with important points; to focus on the areas where negativities are found easy to arise, where public opinions are concerned about corruption, negativities, about the degeneration in the political ideology, morality and lifestyle. To promote the mechanism of participation of the Central Steering Committee about the prevention and combat against corruption and negativities, the steering committees at the provincial level, the Vietnam Fatherland Front, the political and social organizations at different levels, the people and the communications and press agencies in the supervisory activities, in which there is supervision of the implementation of the law on the prevention and combat against corruption and negativities.

Based on the actual situation, the research work has integrated the content of prevention and combat against negativities in the report on the prevention and combat against corruption. Accordingly, annually, the Government, the Supreme People’s Court, the Supreme People’s Procuracy have to make a report to the National Assembly on this content, the Justice Committee of the National Assembly chairs and coordinates with the Ethnic Council, the other Committees of the National Assembly to carry out the inspection. At the year-end sessions, in the necessary cases, it is possible to arrange for the National Assembly to consider the report on the prevention and combat against corruption and negativities together with the consideration of the report on carrying out thrifitness and combating against wastefulness.

Fourthly, to perfect the mechanism on the coordination between the National Assembly and the Party organizations, the Vietnam Fatherland Front, the political and social organizations in the supervisory activities to promote the supervisory role of each agency so as to create the resonance together to accelerate and improve the quality and effectiveness in controlling the powers. To intensify the relationship; in coordinating and supplying information between the National Assembly and the Inspection Committees at different levels of the Party, the Vietnam Fatherland Front, the State Audit in the power controlling activities. To enhance the connection and determination of the supervision content  between the supervisory activities of the National Assembly and the supervision of the People’s Council, the social supervision of the Fatherland Front and the political and social organizations, the direct supervision of the people.

Fifthly, to review, summarize, assess and study the propsals for amendment and addition of a number of provisions of the law on the supervisory activities, especially the Law on the Supervisory Operation of the National Assembly and the People’s Council to be suitable to the power controlling requirements in the new situation. To ensure the supremacy in the supervisory activities of the National Assembly for the operation of the state apparatus; to continue the renovation in getting confidence vote and confidence voting for the titles elected or ratified by the National Assembly, to implement the establishment of the Provisionary Committee when necessary in accordance with the stipulations of the Law on National Assembly Organization.

Staring from the comprehensive consideration of the principle of organization of the state power, the role of supreme supervision of the National Assembly in the mechanism of the power control, it can be seen that the renovation and improvement of quality of the supervisory activities of the National ssembly is the issue having been implemented by the National Assembly and it has manifested through the changes in the mindset and the way of doing things in order to contribute to controlling the state power, to organize the successful implementation of the lines and advocacies of the Party, the policies and laws of the State. Supervision has to be based on the very constructive spirit; between “building” and “combating”, building remains fundamental and long; combating must be fierce, thorough-going, urgent; all the good models, the good ways of doing things, the good people, the good deeds must be promoted; a balanced and objective assessment is needed to continue to perfect the institution and system of the law, continue to improve the effectiveness in organizing the implementation for the good of everything, thus making a contribution to the economic and social development and the national construction. The National Assembly has always to renew itself, each agency of the National Assembly has to carry out satisfactorily its own supervision, each National Assembly deputy has to control their own activities in the process of realizing their tasks, rights and responsibilities before the voters so as to really “open up a new stage overbrimmed with fine prospects in the National Assembly opperation”./.
