Completing the organization and operation of People’s Courts to build the socialist State governed by law of Viet Nam

To implement the Party’s viewpoints and orientations on renovation of the court system’s organization and operation, the People’s Supreme Court has developed and finalized the master plan on building regional people’s courts of first instance, people’s courts of appeals, and people’s supreme courts; renovated the organization and operation of the people’s supreme Court; developing objectives, principles, orientations, content, steps and responsibility in preparation of necessary conditions for reorganization of the court system in the framework of judicial reform.

In doing so, it is necessary of clearly identify the following fundamental issues. First, principles on establishment, tasks, authority and number of regional people’s courts of first instance; relations of the regional people’s courts of first instance with higher courts; the Party’s leadership and oversight of People’s Councils towards regional people’s courts of first instance. Second, principles on establishment of people’s courts of appeals, the Party’s leadership and oversight of People’s Councils towards people’s courts of appeals. Third, principles on establishment, position, authority and number of people’s high courts, their organizational structure, number of employees, the Party’s leadership and oversight of elected bodies and organizational management of people’s high courts. Fourth, position, task, authority and organizational structure of the people’s supreme courts, the Party’s leadership and oversight of elected bodies over people’s supreme courts./.
